  • Client: Any professional or capable natural person as defined by Articles 1123 and following of the Civil Code, or legal entity, visiting the Site subject to these general terms and conditions.

7. Management of personal data.

The Client is informed of the regulations concerning marketing communication, the law of June 21, 2014 for confidence in the Digital Economy, the Data Protection Act of August 6, 2004, as well as the General Data Protection Regulation (GDPR: n° 2016-679).

7.1. Data controllers

For the Personal Data collected during the creation of the User's personal account and their navigation on the Site, the data controller is: BDC WINE AGENCIES. https://avinum.be is represented by Martin De Coster, its legal representative.

As the controller of the data it collects, https://avinum.be commits to respecting the legal framework in force. It is notably the Client's responsibility to establish the purposes of its data processing, to provide its prospects and clients with full information about the processing of their personal data from the time their consent is collected, and to maintain a record of processing operations that reflects reality. Whenever https://avinum.be processes Personal Data, it takes all reasonable measures to ensure the accuracy and relevance of the Personal Data with respect to the purposes for which https://avinum.be processes it.

7.2. Purpose of the data collected

https://avinum.be may process all or part of the data:

  • to enable navigation on the Site and manage and track the services ordered by the user: connection and Site usage data, billing, order history, etc.

  • right to define the fate of User data after their death and to designate a third party to whom https://avinum.be must communicate (or not) their data

Once https://avinum.be becomes aware of the death of a User and in the absence of instructions from them, https://avinum.be commits to deleting their data, unless their retention is necessary for evidentiary purposes or to meet a legal obligation.

Additionally, https://avinum.be does not collect any “sensitive data.”

The User's Personal Data may be processed by subsidiaries of https://avinum.be and subcontractors (service providers) solely to achieve the purposes of this policy.

To the extent of their respective attributions and for the purposes mentioned above, the main people who may have access to the data of Users of https://avinum.be are primarily our customer service agents.
 

8. Incident Notification

Regardless of the efforts made, no method of transmission over the Internet and no method of electronic storage is completely secure. Consequently, we cannot guarantee absolute security.
